The Mission of the Water and Land Office is to promote the protection of Marshall County’s surface water, ground water and related land uses through the implementation of environmental programs and appropriate administration of the County’s zoning ordinances.  Direction for the County’s policy is obtained from the Marshall County Local Water Management Plan, the Marshall County Comprehensive Land-Use Plan and the Marshall County Water Resource Advisory Committee.

PRELIMINARY FLOOD INSURANCE RATE MAPS

  • The preliminary flood maps are available for your review and comment on Marshall County and Incorporated Areas. The County will be notified in 2012 when the 90 day appeal process starts.

PERMIT REQUIREMENTS IN THE COUNTY

 

Septic systems in all areas of the county require permits.  A permit is required prior to installation and must be obtained from the Water and Land Office. All sewage systems in the County must have soil verifications. All septic systems shall be designed, installed, inspected, altered and repaired by a MN licensed ISTS professional except as provided under MN Rules 7083. Minimum lot size for a property with a septic system is one (1) acre with room for two drain fields.

Building, land use and septic systems permits are required in the Floodplain and Shoreland Zoning Districts of Marshall County. Minimum lot size for a property is one acre.

Permits in floodplain and shoreland areas are required for:

  • The construction of buildings, additions, decks and remodeling
  • The installation, repair and or alteration of sewage treatment systems
  • (privies and holding tanks require permits also)
  • The placement of roads, driveways and parking areas
  • Construction and modification of feedlots
  • Specific grading, filling and other land alteration activities
  • Other

Applications for permits must be submitted with time allowed for the technical work of soil verifications, determination of ordinary high water lines for setbacks, floodplain elevations and for application reviews. 

 

MARSHALL COUNTY BOARD OF ADJUSTMENT

The Board of Adjustment is a 5-member committee appointed by the Board of Commissioners.  The members serve 3-year terms.  The Board of Adjustment meets on an as-needed basis.

The Board of Adjustment conducts public hearings for written requests for Variances and Appeals of an Administrative Decision made by the Marshall County Zoning Administrator in accordance with Minnesota Statue 394.27.  Applicants have the right to appeal any decision made by this board to district court within 30 days after receipt of notice of the decision.

 

MARSHALL COUNTY WATER RESOURCES ADVISORY COMMITTEE

In 1990, the first Local Water Management Plan was adopted. A diverse group of local, state and federal agencies and citizens were selected to serve as members of the Water Resource Advisory Committee.  The 3rd generation plan was approved in 2007.

The purpose of the Local Water Management Plan is to identify existing and potential problems and opportunities for protection, management and development of water resources and related land resources in Marshall County.  Through the direction of the MN Board of Water and Soil Resources, specific priority concerns are identified and assessed for ongoing goals and actions of the water management plan.
